These bills create loopholes that allow employers who violate the law, including repeat offenders, to avoid meaningful consequences, while employers who already follow the rules gain nothing.

Workers would be required to notify employers of violations and wait for correction before enforcement can occur, putting the burden on workers and increasing fear of retaliation.

Employers would be allowed to argue that workers who report violations were not “serious” job applicants, forcing courts to examine a worker’s intent rather than whether the employer broke the law.

Taken together, these bills shift power away from workers and toward employer discretion, reducing workers’ ability to challenge inequities, even when violations are clear.
